This work is the result of a bibliographical and jurisprudential study about the balance between principles and rights constitutionally recognized in Brazil, especially those relating to human dignity, equality and freedom of speech, passing through the first three dimensions of rights recognized by classical doctrine. Through the theoretical analysis in comparison with recent situations in the national scenario brought to judgment by the Supreme Court, it seeksput light on the debate about the limits and guarantees of fundamental rights through the negative and positive action of the State, culminating in the identification of hate speech as the point of balance of such relationships, with no intent, however, to exhaust the subject.
