Supreme federal court and access to justice in the context of democratic crisis

Resumo: | The Federal Supreme Court is usually studied under an eminently dogmatic constitutional approach. However, it is understood that this prism, by itself, is insufficient to tackle complex and comprehensive issues such as access to justice and protection of human rights. In this way, the aim is to answer the following problem: To what extent can the expression “mainly” (art. 102 of the Constitution) constitute an instrument for the redefinition of the institutional-democratic function of the STF with regard to access to justice? Therefore, an analysis of the joint literature review on the theme democracy-human rights will be sought, relating it to the discussion about the institutional function of the STF. |

Entende-se, contudo, ser este prisma, por si só, insuficiente ao enfrentamento de temáticas complexas e abrangentes, como o acesso à justiça e a proteção aos direitos humanos. Desta forma, visa-se a responder ao seguinte problema: Em que medida a expressão “precipuamente” (artigo 102 da Constituição) pode constituir instrumento de ressignificação da função institucional-democrática do STF no tocante ao acesso à justiça?
