Resumo: The present study has as its scope the analysis of the condition of the retired elderly with suspended work contract under provisional measure nº 936/2020 (converted in Law nº 14.020/2020), without receipt of emergency benefit and its correlation with injured personality rights, mainly the right to health. Through inductive method, it begins with the analysis of the mentioned law, through the current panorama of Covid-19 pandemic. It asserts the conditions regarding the retired elderly, that (re)inseres in the labor marked faced with the insufficiency of the retirement and due to the fact that generally needs to contribute to the familiar budget. It describes both normative texts in relation to personality rights. It concludes that the participation of syndicates is crucial to guarantee better conditions to the retired elderly worker.

Mediante o método indutivo, inicia-se a análise da lei retromencionada, sob o prisma do panorama atual da pandemia de Covid-19. Aborda-se as condições do idoso aposentado, que se (re)insere no mercado de trabalho diante da insuficiência da aposentadoria e de geralmente necessitar de contribuir ao orçamento familiar. Descrevem-se os mencionados diplomas normativos em relação aos direitos da personalidade.
