The protection of the individual against the use of force by the states in the interamerican human rights system

This paper was carried out to assess the effectiveness of the Interamerican Human Rights System in the sense of protecting the rights inherent to the person regarding the use of force by the State. For such, by using qualitative documentary and exploratory research techniques from bibliographic sources, developed under the hermeneutic-argumentative theoretical model and under the dialectic and comparative methods, the provisions of the Interamerican system on the use of force by the State are analysed, assessing the parameters established from the law based instruments and from the exegeses carried out by the Interamerican Commission and Court. Furthermore, the international responsability of the States are detailed at the moment when they practice the ilegal action of using their coercive force outside the parameters established by the Interamerican System. As a result of that, taking to consideration the fact that said system establishes clear parameters for limiting the state prerogative of the use of force, and also provides procedural mechanisms allowing the individual’s acess to a jurisdictional body, asking for the protection of his rights, it’s conclusive that the Interamerican System ensures effective protection of his human rights to the individual facing the use of force by the State, either preventing violations or seeking due international accountability of violating States.
