The right of resistance and the myth of the democratic management of education: the case of occupations of schools in the state of São Paulo

Resumo: The recent occupations of state schools of São Paulo proved to be an energetic way of protest in opposition to the “School Reorganization Program”. This kind of actions shows a clear connection with political acts of resistance. In this sense, the article aims to study, in the light of the program, the exercise of the right of resistance. For this purpose, it starts with a brief exposition of the program, followed by a presentation of the reactions against it, with focus on schools occupation. In this context, it investigates the law enforcement duty and the right of resistance. Then it evaluates, from a systemic interpretation of Brazilian law, the constitutionality and fairness of the program, considering the principle of democratic management of education. Finally, the article analyzes the effectiveness of such measures as a way of encouraging the development of the democratic state.

Ações desta natureza apresentam nítida correspondência com atos políticos de resistência, razão pela qual este artigo tem como objetivo analisar, à luz do referido programa, o exercício do direito de resistência. Para tanto, parte-se de uma breve exposição sobre a medida, seguida das reações contrárias ao programa, com foco na ocupação das escolas. Apresenta-se a questão da obrigatoriedade de cumprimento da lei e do direito de resistência, para então avaliar, a partir de uma interpretação sistêmica do ordenamento jurídico brasileiro, a constitucionalidade e a justiça do referido projeto, tendo em vista o princípio da gestão democrática da educação.
