Resumo: O artigo propõe tecer reflexões sobre o ativismo judicial, analisando se a conduta proativa do Poder Judiciário, em especial, do Supremo Tribunal Federal, em ações afirmativas em favor das minorias sociais, não estaria indo de encontro ao seu próprio papel (contramajoritário) ou se estaria ele correto, considerando que atualmente se enfrenta uma crise de representatividade no Brasil. Para tanto, analisa-se a contribuição da teoria da justiça proposta por John Rawls, sobretudo em se tratando de uma sociedade “não-ordenada” como a nossa.
