Resumo: | This research aims to analyze the admissibility of the implementation of public health policies as determined by the Judiciary, in the case of state inertia, and to present the Public Civil Action (PCA) as one of the main instruments for this achievement. The reason for choosing the topic stems from its practical, theoretical and current relevance, especially because collective actions are shown to be an effective instrument in the defense of health. Through theoretical-bibliographic research on the legal, doctrinal and jurisprudential basis on the subject using the dialectical method, it was concluded that the role of the Judiciary in the achievement of public health policies occurs in a subsidiary and exceptional way, only arising due to state inertia. In addition, the PCA appears as a procedural instrument which the Public Ministry's Office and the Public Defender's Office use to defend the health of the population against the inertia of jointly responsible federative entities. |

A justificativa da escolha do tema decorre de sua relevância prática, teórica e atual, especialmente porque as ações coletivas mostram-se como um instrumento eficaz na defesa da saúde. Por meio da pesquisa teórico-bibliográfica da base legal, doutrinária e jurisprudencial sobre o tema com utilização do método dialético, concluiu-se que a atuação do Poder Judiciário na consecução das políticas públicas de saúde ocorre de maneira subsidiária e excepcional, só surgindo devido à inércia estatal.
