The inter-american court of human rights and protection of indigenous peoples: : analysis in light of the evolutionary interpretation of human rights

Resumo: This research work is related to the main advancements, in recent years, of the Inter-American Human Rights System regarding indigenous rights. The question posed is how the international protection regime promoted by the Inter-American Court can face the challenge of safeguarding rights inherent to the reality of indigenous peoples and their particular worldviews, such as collective property, the cosmovision of territoriality, and cultural manifestations. In this sense, it is intended to demonstrate the legal foundation adopted by the Inter-American Court that allowed the expansion of the protection of rights contained in the American Convention on Human Rights. The execution methodology is based on the inductive method and starts from bibliographic, documentary, and jurisprudential analysis.

A questão que se coloca é de que modo o regime de proteção internacional promovido pela Corte Interamericana tem enfrentado o desafio de salvaguardar direitos próprios da realidade dos povos indígenas e de suas particulares percepções de mundo, como a propriedade coletiva, a cosmovisão da territorialidade e as manifestações culturais. Nesse sentido, pretende-se demonstrar a fundamentação jurídica adotada pela Corte Interamericana que permitiu ampliar o leque de proteção dos direitos contidos na Convenção Americana de Direitos Humanos.
