Regulatory Sandbox and the medical use of Cannabis: an analysis under the Law and Economics premises

This article aims to analyze what contributions the Regulatory Sandbox can provide in the construction of a certain standard. The entire analysis is done under the premises of Law and Economics, as well as the foundations, principles and purposes of the Economic Order established in the Federal Constitution of 1988. The method used was the deductive-statistical method, obtaining information through bibliographic, legislative and jurisprudential. It was found that the Regulatory Sandbox is an instrument that contributes to the creation of effective standards. In this tuning fork, there is the regulatory process of Cannabis for medicinal purposes in Brazil, which is of great relevance. Authorization by the National Health Surveillance Agency (ANVISA) for the production of medications for palliative treatments based on Cannabidiol will represent cost reduction, increased free competition, guarantee of free initiative that will bring about an increase in social well-being.
