This work is part of the analysis of the economic regulation under the rise of new technologies in the financial sector, with particular focus on the characterisation and examination of regulatory sandboxes as an alternative regulatory instrument, inserted in a perspective of facilitating innovation, a growing and revolutionary phenomenon of the current global economy. Driven by disruptive technological innovation, economic regulation also gains new contours, also aimed at new products, services and business models, having the necessity to be balanced to mitigate risks and promote economic efficiency, alongside with consumers and marketing protection against comprehensive systemic risks. This paper follows the scope of Administrative and Regulatory Law, having the European Union as its central geographic area, more specifically Portugal and has, as an objective scope, the delimitation of a new alternative regulatory regime in the context of financial innovation. Faced with new global technological and economic realities, the search for increasingly efficient and disruptive regulation imposes a dynamic of experimentalism on the traditional regulatory model, once based on observation, which will then start testing innovative experimental products and services, subject to specific regulatory requirements. It is through this conditioned environment of greater dialectics and dynamics in the relationship between regulated and regulatory authorities, capable of promoting financial innovation, that the theory of the regulatory sandbox is developed.
