Resumo: RESUMOO artigo pretende examinar a tensão entre concepções que se confrontaram quando o STF entendeu que o início da execução penal poderia ocorrer a partir de acórdão proferido pelo juízo de segunda instância. Traça, como ponto de partida, paralelos entre o órgão judiciário de cúpula da ONU e o Supremo Tribunal Federal, entre a sociedade internacional e a sociedade brasileira.Palavras-chave: Execução Penal; Supremo Tribunal Federal; Direito Internacional.ABSTRACTThe article aims to analyse the conflict of conceptions that took place when the Supreme Federal Court ruled that the criminal sentence could be executed after an intermediate appellate court’s ruling. It draws a parallel, as a starting point, between the judicial organ of the UN and the Supreme Federal Court, comparing the Brazilian and international societies.Keywords: Criminal Enforcement; Supreme Federal Court; International Law.
