RESUMOO pluralismo de uma sociedade heterogênea requer salvaguardas jurídicas. O fundamento da convivência social deve ser buscado num plano mais abstrato e universal, que constitui a democracia sob a base dos direitos fundamentais. Impõe-se, assim, uma separação entre o domínio profano do Estado e o domínio espiritual da religião. Como, então, o Estado deve posicionar-se em relação ao direito de religião num ambiente multicultural, em que convivem diversas concepções e diferentes religiões, nem todas dotadas das mesmas condições? A solidariedade indispensável para a coesão social e a vida comunitária carece agora de um novo sustentáculo: ela deve ser “mediada juridicamente”, ao passo que o Estado deve buscar “uma fonte secularizada de legitimação”. As condições de legitimidade das sociedades complexas contemporâneas devem ser buscadas na mediação jurídica, especialmente nos direitos fundamentais universalizados.Palavras-chave: Liberdade Religiosa; Multiculturalismo; Solidariadade; Direitos Fundamentais.ABSTRACTThe pluralism of a heterogeneous society requires legal safeguards. The foundation of social coexistence must be sought in a more abstract and universal way, which is democracy under the scope of fundamental rights. There needs to be a separation between the profane domain of the State and the spiritual domain of religion. Thus, how must the State position itself in relation to the right to freedom of religion in a multicultural environment, where several conceptions and different religions coexist, not all endowed with the same conditions? Solidarity - which is essential for social cohesion and community life - lacks a new mainstay: it must be legally mediated, while the State must seek a secular source of legitimation. The conditions of legitimacy of the complex contemporary societies must be sought in the legal background, especially regarding universal basic rightsKeywords: Freedom of Religion; Multiculturalism; Solidarity; Fundamental Rights.
