This article aims to analyze cyberdemocracy and the construction of identity in cyberspace, interconnecting them with the issue of digital exclusion under the prism of personality rights. The research is guided by the following issues: What are the challenges and possibilities of cyberdemocracy, in particular, in the construction of identity? What are the impacts of this on the very personal sphere of the digitally excluded groups? For this, it uses the hypothetical-deductive method and employs the methodology of bibliographic review. As a result, it has, in short, that digital exclusion is a challenge to cyberdemocracy, affecting citizens who live in rural areas and from the lower classes. Also that, due to the new democratic alternatives in cyberspace, the construction of identity is being influenced by technologies, therefore those who are in digital exclusion have their identity construction impaired, since they are left on the margins of the space where cyberdemocracy takes place and identities are constructed.
