Resumo: | After the redemocratization process, the phenomenon of judicial activism became directly linked to judicial activity. The term is used to accentuate the interference of the Judiciary in the scope of the other Constituted Powers. It so happens that the phenomenon has been confused with the judicialization of politics, and both, despite being directly linked to the jurisdictional activity, are distinct. With this, the objective is to demonstrate that the lack of a theoretical commitment in defining judicial activism makes the expression take on different meanings, causing great problems, notably, when the phenomenon is confused with judicialization. It could be concluded that dissociating the expressions is essential to be able to understand activism as a problem, which must be faced as such. The study was elaborated by bibliographical and documental research, in the area of constitutional law, being the collected data analyzed by the hypothetical-deductive and dialectical methods. |

O termo é utilizado para acentuar a interferência do Judiciário no âmbito dos outros Poderes Constituídos. Ocorre que, o fenômeno, vem sendo confundido com a judicialização da política, sendo que, ambos, apesar de estarem diretamente vinculados à atividade jurisdicional, são distintos. Com isso, objetiva-se demonstrar que a falta de um comprometimento teórico em definir-se ativismo judicial faz com que a expressão assuma variados sentidos, acarretando grandes problemas, notadamente, quando o fenômeno é confundido com a judicialização. Pôde-se concluir que a dissociar as expressões é imprescindível para poder compreender o ativismo como um problema, que deve ser enfrentado como tal. O estudo foi elaborado por pesquisa bibliográfica e documental, na área de direito constitucional, sendo os dados levantados analisados pelos métodos hipotético-dedutivo e dialético.Centro Universitário Salesiano de São Paulo - U.E.
