The Context of Brazilian Federalism: possibilities for intergovernmental cooperation via public consortia

Resumo: This article is part of the field of studies on federalism, based on the Brazilian reality after Constitution Federal the 1988. The objective is to present the intergovernmental cooperation mechanisms, used by public consortia, in order to verify their performance and spatiality in a regional dimension. The problem addressed is part of the economic changes that occurred since the 1990s, which brought to light the fragility of the Brazilian “federative pact”, given the loss of financial capacity and coordination between subnational governments. For analysis, the theoretical framework requires multidisciplinary knowledge that involves, to a greater or lesser degree, theoretical views related to economic, historical, political, legal sciences, among others. The research methods are divided into two parts: the first is based on bibliographic research of an analytical character, and the second uses data from the “Observatory Municipal of Public Consortia”. Based on it, we seek to verify the spatiality and performance of public consortia. In regional terms, the main results show that consortium experiences are concentrated in the Southeast (43.6%) and South (30.8%) regions, and operate mainly in the sectors that involve health, the environment, solid waste, and sanitation. With this characteristic, it appears that when gaining legal support in 2005, public consortia are seen as instruments of cooperation that can enhance the capacity of subnational governments to implement public policies, given the fact that they are integrated with the dynamics regional development.

El objetivo es presentar los mecanismos de cooperación intergubernamental, utilizados por los consorcios públicos, para verificar su desempeño y espacialidad en una dimensión regional. El problema abordado es parte de los cambios económicos que ocurrieron desde la década de 1990, que pusieron de manifiesto la fragilidad del "pacto federativo" brasileño, dada la pérdida de capacidad financiera y la coordinación entre los gobiernos subnacionales. Para el análisis, el marco teórico requiere un conocimiento multidisciplinario que involucra, en mayor o menor medida, puntos de vista teóricos relacionados con las ciencias económicas, históricas, políticas, jurídicas, entre otros. Los métodos de investigación se dividen en dos partes: la primera se basa en una investigación bibliográfica de carácter analítico, y la segunda utiliza los datos del “Observatorio Municipal de Consorcios Públicos”. A partir de él, buscamos verificar la espacialidad y el desempeño de los consorcios públicos. En términos regionales, los principales resultados muestran que las experiencias del consorcio se concentran en las regiones del Sudeste (43.6%) y del Sur (30.8%), y operan principalmente en los sectores que involucran la salud, el medio ambiente, desechos sólidos y saneamiento. Con esta característica, parece que al obtener apoyo legal en 2005, los consorcios públicos son vistos como instrumentos de cooperación que pueden mejorar la capacidad de los gobiernos subnacionales para implementar políticas públicas, dado que están integrados con la dinámica. desarrollo regional.O presente artigo se insere no campo dos estudos sobre o federalismo, a partir da realidade brasileira pós-Constituição Federal de 1988. O objetivo é o de apresentar os mecanismos de cooperação intergovernamental, instrumentalizados pelos consórcios públicos, a fim de verificar sua atuação e espacialidade em dimensão regional. A problemática tratada parte das mudanças econômicas ocorridas a partir da década de 1990, que fizeram vir à tona a fragilidade do “pacto federativo” brasileiro, dada a perda de capacidade financeira e de articulação entre os governos subnacionais. Para a análise, o referencial teórico requer um conhecimento multidisciplinar que envolve, em maior ou menor grau, visões teóricas ligadas às Ciências econômicas, históricas, políticas, jurídicas, entre outras. Os métodos de pesquisa se dividem em duas partes: a primeira se baseia em uma pesquisa bibliográfica de caráter analítico, e a segunda utiliza os dados do “Observatório Municipalista de Consórcios Públicos”. A partir dela, busca-se verificar a espacialidade e a atuação dos consórcios públicos. Em dimensão regional, os principais resultados mostram que as experiências de consorciamento estão concentradas nas regiões Sudeste (43,6%) e Sul (30,8%), e atuam, principalmente, nos setores que envolvem a saúde, o meio ambiente, os resíduos sólidos e o saneamento.
