AN INVITATION TO THE TABLE: Absence, Inclusion and Corporate Advocacy

Resumo: In view of the imbalance between the presence of women and men in the legal sector, especially in the legal profession and the judiciary, the aim of this article is to expose the layers of absence and presence. Firstly, with an analytical bias, the results of the profiling of the Brazilian legal profession and judiciary were presented, followed by a section on Sergipe. To guide the debate, the concepts of the glass ceiling and the masculinization of command and feminization of subalternity were briefly presented. Then, in order to make an informed contribution to the problem at hand, we worked with the concepts of diversity and inclusion, with a view to concatenating the ideas to expand on the next topic, which is the need to align the legal sector with the metrics commonly applied and associated with corporate governance, ESG, environmental, social and governance. Finally, despite the gap in the Brazilian literature, work is done on the recent expansion of the qualitative use of ESG factors in the legal profession, with an emphasis on the principle of equity. In order to achieve the objective, an exploratory and descriptive study was carried out, using an analytical and deductive approach and documentary and bibliographic sources. In addition, in order to organize this study, careful data collection was carried out, corresponding to the first methodological stage of the research, aimed at analyzing the profiles of the Brazilian legal profession and judiciary. With regard to the bibliographic survey, the second methodological phase, there was a limitation due to the Brazilian references, deepened by the specificity of the research in terms of the legal field marker.

En primer lugar, con un sesgo analítico, se presentan los resultados del perfil de la abogacía y la judicatura brasileñas, seguidos de una sección sobre Sergipe. Para orientar el debate, se presentaron brevemente los conceptos de techo de cristal y de masculinización del mando y feminización de la subalternidad. A continuación, con el fin de hacer una contribución informada al problema en cuestión, se trabajó con los conceptos de diversidad e inclusión, con el fin de concatenar las ideas para ampliar al tema siguiente, que es la necesidad de alinear el sector jurídico con las métricas comúnmente aplicadas y asociadas a la gobernanza corporativa, ESG, ambiental, social y de gobierno. Por último, a pesar del vacío en la literatura brasileña, se trabaja en la reciente expansión del uso cualitativo de los factores ASG en la abogacía, con énfasis en el principio de equidad. Para alcanzar el objetivo, se realizó un estudio exploratorio y descriptivo, utilizando un enfoque analítico y deductivo y fuentes documentales y bibliográficas. Además, para organizar este estudio, se realizó una cuidadosa recolección de datos, correspondiente a la primera etapa metodológica de la investigación, destinada a analizar los perfiles de la abogacía y de la magistratura brasileñas. Con relación al levantamiento bibliográfico, segunda fase metodológica, hubo una limitación debido a las referencias brasileñas, profundizada por la especificidad de la investigación en cuanto al marcador del campo jurídico.Diante do cenário de desbalanço entre a presença feminina e masculina nos segmentos jurídicos, especialmente nos escalonamentos de poder da advocacia e da magistratura, objetivou-se com o presente artigo expor as suas camadas de ausência e presença. Em primeiro momento, com um viés analítico, expôs-se os resultados do perfilhamento da advocacia e magistratura brasileira, seguida com um recorte sergipano. Para orientar o debate, sucintamente foram apresentados os conceitos sobre os fenômenos do teto de vidro e da masculinização do comando e feminização da subalternidade. Em sequência, para contribuir de forma fundamentada com a problemática em voga, trabalhou-se com os conceitos atinentes a diversidade e inclusão, com vistas a concatenar as ideias para expandir ao próximo tópico, consistente na necessidade de alinhamento do setor jurídico com os índices métricos, comumentemente aplicados e associados à governança corporativa, ESG, environmental, social and governance. Ao final, apesar da lacuna bibliográfica brasileira, trabalha-se sobre a recente expansão do uso qualitativo dos fatores ESG na advocacia, com ênfase no princípio da equidade. Para a concretização do objetivo, adotou-se uma pesquisa de natureza exploratória e descritiva, com método de abordagem analítica e dedutiva, em fontes documentais e bibliográficas. Adicionalmente, sobre a organização deste estudo, fez-se criteriosa coleta de dados, correspondente a primeira etapa metodológica da pesquisa, voltada a análise dos perfis da advocacia e magistratura brasileira.
