ACADEMIC SPIN-OFFS IN BRAZIL: LEGAL ANALYSIS AND MULTIPLE CASE STUDY

Resumo: Universities play an important role in promoting entrepreneurship, noting that a favorable ecosystem is critical for so-called academic spin-offs. Such companies come from ideas and knowledge acquired by the researcher through his activities in the institution to which he is linked, for the purpose of commercializing intellectual property or products derived from his research. This qualitative study analyzed the influence of bureaucracy in public universities, regarding the generation of business resulting from their research. To do so, it enters the space for promoting innovation and entrepreneurship at selected universities. An inductive approach was used to analyze the norms of the Federal Universities of Sergipe (UFS), Minas Gerais (UFMG) and Pernambuco (UFPE). In order to deepen the knowledge about the innovation policy, a case study was carried out with professors guiding the projects selected in the Program for Inducing the Creation of Startups, promoted by UFS, referring to the public notice published in 2021. The concern of the institutions was verified selected with technological innovation and entrepreneurship, having norms linked to business generation. It was possible to recognize a significant legislative advance of the UFS after the publication of its new innovation policy, in 2022, eliminating the legal insecurities of the previous regulation and expanding the opportunities for university entrepreneurship, with a major revision of its organizational structure for innovation and entrepreneurship, which makes its policy more comprehensive than the other selected institutions. It was identified that excellent management needs to be linked to the innovation policy for the advancement of academic entrepreneurship.   Descritores: Entrepreneurship; Innovation; Business; Spin-offs.

Tales empresas se originan a partir de ideas y conocimientos adquiridos por el investigador a través de sus actividades en la institución a la que está vinculado, con el fin de comercializar propiedad intelectual o productos derivados de su investigación. Este estudio cualitativo analizó la influencia de la burocracia en las universidades públicas, respecto a la generación de negocios producto de sus investigaciones. Para ello, se adentra en el espacio de fomento de la innovación y el emprendimiento en universidades seleccionadas. Se utilizó un enfoque inductivo para analizar las normas de las Universidades Federales de Sergipe (UFS), Minas Gerais (UFMG) y Pernambuco (UFPE). Con el fin de profundizar en el conocimiento sobre la política de innovación, se realizó un estudio de caso con profesores orientadores de los proyectos seleccionados en el Programa de Inducción a la Creación de Startups, promovido por la UFS, en referencia al aviso público publicado en 2021. La preocupación de los Se verificó instituciones seleccionadas con innovación tecnológica y emprendimiento, contando con normas vinculadas a la generación de negocios. Fue posible reconocer un importante avance legislativo de la UFS tras la publicación de su nueva política de innovación, en 2022, eliminando las inseguridades jurídicas de la normativa anterior y ampliando las oportunidades para el emprendimiento universitario, con una importante revisión de su estructura organizativa para la innovación y el emprendimiento, lo que hace que su política sea más integral que las otras instituciones seleccionadas. Se identificó que la gestión excelente necesita estar vinculada a la política de innovación para el avance del emprendimiento académico.     Descriptores: Emprendimiento; Innovación; Negocio; Spin-offs.  As universidades desempenham um papel importante na promoção do empreendedorismo, observando que um ecossistema favorável é fundamental para as denominadas spin-offs acadêmicas. Tais empresas são oriundas de ideias e conhecimentos adquiridos pelo pesquisador por meio de suas atividades na instituição à qual está vinculado, para fins de comercialização de propriedade intelectual ou produtos derivados de suas pesquisas. Este estudo qualitativo analisou a influência da burocracia nas universidades públicas, quanto à geração de negócios resultantes de suas pesquisas. Para isso, adentra no espaço de fomento à inovação e ao empreendedorismo de universidades selecionadas. Uma abordagem indutiva foi utilizada para analisar as normas das Universidades Federais de Sergipe (UFS), Minas Gerais (UFMG) e Pernambuco (UFPE). Para aprofundar o conhecimento sobre a política de inovação, realizou-se um estudo de caso com professores orientadores dos projetos selecionados no Programa de Indução à Criação de Startups, promovido pela UFS, referente ao edital publicado em 2021. Verificou-se a preocupação das instituições selecionadas com a inovação tecnológica e o empreendedorismo, possuindo normas atreladas à geração de negócios. Foi possível reconhecer um significativo avanço legislativo da UFS após a publicação de sua nova política de inovação, em 2022, eliminando as inseguranças jurídicas da regulamentação anterior e ampliando as oportunidades para o empreendedorismo universitário, com uma grande revisão de sua estrutura organizacional para a inovação e empreendedorismo, o que torna sua política mais abrangente do que as demais instituições selecionadas.
