The search for the realization of the fundamental rights of women in prision by the Sergipe’s Female Prisión

Resumo: The population of the women prisioner increased considerably over the last few years. So, it needed to build new prisons to comply this new number of prisoners. However, the women prisioner are subordinated to a double violation of their rights because their special female conditions are ignored because prisons are built to receive only men. This academic project wants to discuss an issue of incarcerated women from a new perspective aiming to analyze means that help in the assure of women's rights in prison. The study also specifically addresses a gender issue as the main impediment to meeting these requirements and portrays the need for social deconstruction of male and female roles. In addition, this work also explains how pregnancy and motherhood in prison occurs, using a qualitative approach, with documentary and bibliographic analysis, based on an inductive, typological and functional method, aiming a practical application. This present work was based on the understanding of the source of the problems of female prisons, promoting a discussion of very critical points, such as access to health inmates and the way that pregnancy occurs in prisons, and brings as a result ways to improve these issues.

Así, surgió la necesidad de crear nuevas cárceles. Las mujeres presas experimentan violaciones de sus derechos dos veces, ya que se ignoran las condiciones de las mujeres, dado que las cárceles están construidas para recibir solo hombres. En este contexto, se pretende discutir acerca de el origen de los problemas de las mujeres, con objetivo de analizar medios auxiliares para hacer realidad los derechos de las mujeres encarceladas. El estudio también aborda específicamente una cuestión de género como el principal impedimento para cumplir con estos requisitos, y retrata la necesidad de la deconstrucción social sobre las practicas masculinos y femeninos. Además, explique cómo ocurren la gestación y la maternidad en la prisión, utilizando un enfoque cualitativo, con análisis documental y bibliográfico, basado en el método inductivo, utilizando una aplicación práctica. De este modo, este trabajo logró su objetivo, con el debate de formas de arreglar los derechos de los presos, en vista de su caracterización sociodemográfica.A população de mulheres encarceradas brasileiras cresceu nos últimos anos. Assim, surgiu a necessidade de criação de novos presídios. As presas se sujeitam a uma dupla violação de seus direitos, visto que as condições femininas são ignoradas, dadas as prisões serem construídas para receberem apenas homens. Nesse âmbito, se pretende discutir a origem dos problemas prisionais femininos, tendo como objetivo analisar meios auxiliares à efetivação dos direitos das mulheres encarceradas. O estudo também abordará, especificadamente, a questão de gênero como principal impedimento do alcance dessas garantias, ao retratar a necessidade de desconstrução social acerca dos papeis masculinos e femininos. Além disso, explanará como ocorre a gravidez e o exercício da maternidade na prisão, através de uma abordagem qualitativa, com análise documental e bibliográfica, se baseando no método indutivo, visando uma aplicação prática.
