MODERN CONCEPTS OF AFFECTION: SHARED CUSTODY OF PETS

Resumo: This article addresses, starting from the Brazilian legal system, the custody of domestic animals in case of dissolution of conjugality, contextualizing the socialization and domestication of the animal and how the law deals with this matter. Non human animals are endowed with sensitivity, and their condition of vulnerability must be recognized and their rights guaranteed, and practices that jeopardize their ecological function, that cause their extinction or subject them to cruelty are expressly prohibited. Some situations regarding animals are not well defined. Brazilian law has a specific provision for cases involving family relationships and the sharing or keeping of animals, but the jurisprudence is vast and the number of demands shows the importance of studying and regularizing this issue.

Los animales no humanos están dotados de sensibilidad y deben tener su condición de vulnerabilidad reconocida y sus derechos garantizados, quedando expresamente prohibidas las prácticas que ponen en riesgo su función ecológica, que causan su extinción o los someten a crueldad. Algunas situaciones animales no están bien definidas. La legislación brasileña tiene disposiciones específicas para los casos de relaciones familiares y el intercambio o custodia de animales, pero la jurisprudencia es amplia y el número de demandas muestra la importancia del estudio y regularización de este tema.O presente artigo aborda, partindo do ordenamento jurídico brasileiro, a guarda de animais domésticos em caso de dissolução da conjugalidade, contextualizando a socialização e domesticação do animal e como o direito trata dessa matéria. Os animais não-humanos são dotados de sensibilidade, devendo ter sua condição de vulnerabilidade reconhecida e seus direitos garantidos, sendo expressamente proibidas práticas que coloquem em risco sua função ecológica, que provoquem a sua extinção ou os submetam à crueldade. Algumas situações referentes aos animais não estão bem definidas.
