Resumo: | The principle of proportionality is used in almost all constitutional jurisdictions as a parameter for judicial review. There is even talk of a “proportiomania”, indicating the recurrence with which the judges use the principle, sometimes divided into subprinciples of adequacy, necessity and proportionality in the strict sense, as developed in the German constitutional jurisprudence between the 1950s and 1960s. Although this “proportionality mania” is the object of criticism, its idea of moderating power and restraining agency, established by the instrumental relationship of justification between means used and pursued ends, is ancient in the history of mankind. It is ventured to say that, from the “archaeological” research of the beginning, “proportionality mania” is connatural to the archetypal “search for justice”. A history of ideality immersed in the restrictions of the real and its contingencies. |

Embora essa “mania da proporcionalidade” seja objeto de crítica, a sua ideia de moderação do poder e contenção do arbítrio, estabelecida pela relação instrumental de justificação entre meios utilizados e fins perseguidos, é antiga na história da humanidade. Arrisca-se a dizer que, a partir da pesquisa “arqueológica” do princípio, a “proporcionomania” é conatural à arquetípica “procura de justiça”.
