COMPLIANCE’S DEMYSTIFICATION ON BRAZIL: How to democratize this integrity system on brazilian northeast?

Resumo: | From the Anticorruption Law expedition, compliance have gained space on brazilian academic, corporative and legal debate. The informed rule was the first brazilian law to approach the objective charge of companies by corruption acts beholding public administration. It brought not only the discussion about the companies relation to public power, but also about how their action’s probity in their respective sectors. It in this scenario that compliance started to be implented on brazilian companies, great corporations only at first, considering they maintain a close relation to public power, for being market leaders and by consequence were the first ones to incur on the crimes provided by the Anticorruption Law. It occurs that on brazilian northeast region, the market has it’s smaller percentage composed by micro and small enterprises (MPE), considering this fact, the present article will analyze the institute of compliance, just as it’s application and viability refferent to micro and small enterprises (MPE) that act on brazilian northeast region, by means of a qualitative, bibliographical, legislative and jurisprudence search. |

It occurs that on brazilian northeast region, the market has it’s smaller percentage composed by micro and small enterprises (MPE), considering this fact, the present article will analyze the institute of compliance, just as it’s application and viability refferent to micro and small enterprises (MPE) that act on brazilian northeast region, by means of a qualitative, bibliographical, legislative and jurisprudence search. A partir da expedição da Lei Anticorrupção, o compliance ganhou espaço no debate acadêmico, corporativo e jurídico brasileiro. A norma informada foi a primeira lei brasileira a abordar a responsabilização objetiva de empresas por atos de corrupção em face da administração pública. Trouxe a baila não somente a discussão sobre a relação das empresas com o poder público, como também sobre a probidade na atuação destas em seus respectivos setores. Foi nesse cenário que o compliance passou a ser implantado nas empresas brasileiras, em um primeiro momento apenas em grandes corporações que mantém relação de proximidade com o poder público, por serem líderes de mercado, e por consequência foram as primeiras a incorrerem nos crimes previstos na Lei Anticorrupção.
