The purpose of this paper is to study the relationship between slavery and abolition with the mass incarceration of young Afro-descendents, as well as with the daily violence against this group in contemporary Brazil. In addition, we reflect on the construction of the association of the black body with crime - a factor that hinders the full access of the African diaspora to the rights guaranteed by the Brazilian constitution and the universal declaration of human rights. Above all, the offer of this paper is a proposal for analysis on the determination of race in the practice of Brazilian justice, also considering the cases of punishment given by a person or group without compliance with the law, based on their own opinions and mainly by racial prejudice. , ie the practice of justice "with one's own hands." We suggest that the criminal justice system is functional to the reproductive instrument of racial domination inherited from the slave period, since it is in its administration, occupied mostly by upper-middle-class whites, that an explicit form of racism is manifested over those most vulnerable to the situation. the production of categories of individuals punishable through repressive apparatus. The guiding thread of the work is a comparison between the condition of enslaved Africans before justice during the period of slavery (1870-88) and the current situation of their descendants before the penal system, pointing out that the mass incarceration of the young Afro population Descendant, the result of criminal selectivity, is an inheritance from the slave system that still informs our present. And that such heritage is part of a political project of domination managed by a portion of the manorial class that survived and disseminated its worldview through influential works of sociology and historiography, stigmatizing and associating blacks with criminality.
