The judicialization of the right to health in a comparative perspective: Brazil and Colombia

Resumo: | This article aims to study the judicialization of health in Brazil and Colombia, from a comparative perspective. The comparative analysis is justified by the historical, political and social affinities existing between these two countries, mainly in relation to colonization and underdevelopment, and for there are consolidated data in both countries, specifically. In this way, through the review of literature on the theme and the analysis of government databases of both countries, the main differences in the management of health care were pointed out, as well as the effects that judicial control over public policies exert on the political and administrative organization of these societies. In the conclusion, it was established that both countries lack the management of health that would enable the inclusion of this fundamental right in the socio-economic development projects of these governments agendas. |
