The consensus methods of resolution conflict as public policy alternative to prison in economic crimes

Resumo: Abstract: In Brazil, the National Council of Justice, through Resolution nº. 125, of November 29, 2010, dealt with the proper treatment of conflicts of interest within the scope of the National Judiciary, affirming the importance of consensus in the proceedings. Based on this resolution, this article aims to analyze the effectiveness of consensual means of conflict resolution as a public policy capable of humanizing criminal responses to economic crimes, in the face of criticism of the intervention of the State in economic law through the penal system. It is concluded that the consensual means of conflict resolution represent a model of response to economic crime capable of reducing the policy of imprisonment, although it does not imply the total suppression of the current remuneration model, and can be used in a residual manner in cases of greater severity.Keywords: Consensus methods of conflict resolution. Prison.Resumo: No Brasil, o Conselho Nacional de Justiça por meio da Resolução nº 125, de 29/11/2010 dispôs sobre o tratamento adequado dos conflitos de interesse no âmbito do Poder Judiciário Nacional, afirmando a importância do consenso nas lides. Com base nesta resolução, este artigo tem o objetivo de analisar a eficácia dos meios consensuais de resolução de conflitos como política pública capaz de humanizar as respostas penais aos delitos econômicos, diante das críticas à intervenção do Estado no direito econômico via sistema penal. Conclui-se que os meios consensuais de resolução de conflitos representam um modelo de resposta ao delito econômico capaz de diminuir a política do encarceramento, ainda que não implique a total supressão do modelo retributivo atual, podendo ser utilizados de maneira residual nos casos de maior gravidade.Palavras-chave: Delitos econômicos.
