Legal feasibility and technical implications of the proposal to extend the term of protection of plant variety protections

Summary: Legislative changes are constantly being proposed which represent practical repercussions in the life of the rights already recognized. In each area of law these repercussions may represent considerable changes in the existing status quo. In view of these issues, this article aims to analyze the feasibility of the proposed legislative amendment of the Law of Protection of Cultivars - Federal Law n. 9,456 / 1997, contained in the Law Project n. 827/2015, which aims, among other points, to extend from 18 years to 25 years the term of protection for perennial and semi-perennial new cultivars and cultivars essentially derived, notably for sugarcane, under the Law of Protection of Cultivars, as well as application of this device to cultivars whose protection has already been recognized.
