Public management and materially democratic state: the social participation in the reform of middle school education

In the post-Constitution of 1988, the consolidation of a culture of access to information, transparency and social participation in the public management in Brazil is seeked. In this scenario, this article brings theoretical reflections on coparticipative democracy and the exercise of dissent and contradictory in the legislative process. Based on case study as the research method, these concepts and theories are applied in the analysis of the effectiveness of social participation in the construction of Law no 13.415/2017, which made changes in the curricular structure of secondary education. In order to do so, the public hearings and consultations held are evaluated, both in the conception of the policy within the Executive and during the process of the MP no 746/16 in the Congress. By the end, it is shown how the mechanisms of participation are used as mere formality in the legislative process, without meaning effective power of influence to the policy-affected people.
