Public management and materially democratic state: the social participation in the reform of middle school education

Resumo: In the post-Constitution of 1988, the consolidation of a culture of access to information, transparency and social participation in the public management in Brazil is seeked. In this scenario, this article brings theoretical reflections on coparticipative democracy and the exercise of dissent and contradictory in the legislative process. Based on case study as the research method, these concepts and theories are applied in the analysis of the effectiveness of social participation in the construction of Law no 13.415/2017, which made changes in the curricular structure of secondary education. In order to do so, the public hearings and consultations held are evaluated, both in the conception of the policy within the Executive and during the process of the MP no 746/16 in the Congress. By the end, it is shown how the mechanisms of participation are used as mere formality in the legislative process, without meaning effective power of influence to the policy-affected people.

Nesse cenário, este artigo traz reflexões teóricas sobre democracia co-participativa e exercício do dissenso e contraditório no processo legislativo. A partir da técnica metodológica de estudo de caso, esses conceitos e teorias são aplicados na análise da efetividade da participação social na construção da Lei nº 13.415/17, que fez modificações na estrutura curricular do ensino médio. Para tanto, avaliam-se as audiências e consultas públicas realizadas, tanto na concepção da política dentro do Executivo como durante a tramitação da MP nº 746/16 no Congresso.
