Resumo: O presente artigo tem por objetivo a análise da modulação do artigo 170-A, do Código Tributário Nacional (CTN), cujo teor trata da vedação à compensação mediante o aproveitamento de tributo antes do trânsito em julgado da respectiva decisão judicial, verificando a rigidez da norma em destaque, focando na análise da compensação no âmbito dos créditos tributários federais, haja vista as diferentes regulações sobre a matéria nas esferas estaduais, distrital e municipais, com destaques na jurisprudência dos Tribunais Regionais Federais e dos Órgão de julgamento administrativos, bem como analisando os reveses das decisões que permitem e que não permitem a compensação tributária antes do trânsito em julgado.
