This dissertation aims to discuss the behavior of Brazilian criminal policy during periods of relevance in the twentieth century, including those faced after the promulgation of the constitution of the republic of 1988. Above all, talking about the way in which it was applied during the periods and how the classic liberal concepts, contained in all Brazilian codifications and constitutions, were observed in the legislative production of criminal laws, as well as in their application by the operators of the law. The research hypothesis resides in the idea that criminal policy is used, although always structured within the theoretical precepts, in an opportunistic way by the hegemonic groups of the political moment. Still, several points of criminal dogmatics were debated, from its main theoretical bases, to its application during exception periods.
