This thesis proposes to investigate the behavior of political parties in the face of the legal obligation to invest, annually, at least 5% (five percent) of the public money they receive from the Party Fund in initiatives that increase the presence of women in politics, such as seminars, courses or lectures, as well as other acts aimed at electoral, party, parliamentary and public management education. Established in 2009, it was an affirmative action of gender that initiated a structural reform in the political-party system, in order to integrate women in a traditionally male environment. The idea was to consolidate a new collective conscience: that women could and should be part of politics as a protagonist. However, more than ten years after the advent of the incentive measure, women still find it difficult to establish themselves on the political scene. After all, what was the treatment given by the associations to the party program to encourage the participation of women in politics? To answer this question, I divided the thesis into three chapters. In the first, I talk about the concept of gender inequality, aiming to establish the reasons that led Brazil to establish affirmative actions in politics. In the second, I show what the incentive measures adopted by Brazilian electoral legislation were, the effects they had on the elections and how they have been changed over the years. Finally, I analyze how the political parties legally established in the country proceeded in the face of affirmative action that required the application of public resources in programs in favor of women's political participation. The development of the research used both national and international bibliographies on gender inequality, in addition to analyzing more than 100 judicial decisions handed down in party accountability processes that were processed before the Superior Electoral Court. With this, I hope to have presented elements that can contribute to safeguarding the constitutional postulate of equality between men and women.
