Resumo: | For over two centuries, women have been fighting for equality in the world, and it’s been about thirty years that women achieved formal equal position in Brazilian Constitution. However, there is a long path to be taken in relation to the achievement of gender equality, since it was noticed that, over the course of time, inequality has much more to do with the imposition of differentiated behavior patterns to men and women, denominated gender patterns, than with biological differences existent between the genders. The domestic role performed by women in the private life puts them in an inferior situation, which radiates to public and non-private realm, in such a way that the maintenance of gender distortions may be an indicative of the inefficiency of the normative system in this area. While State authority does not interfere in the individual domestic field, little will change in the public and non-private realm, especially in social environment and in labor market. This weighting passes by the content of freedom and of constitutionally guaranteed privacy delimitation, when directed towards women protection. The transformation of maternity leave and paternity leave, with the establishment of parental leave, the publicization of chores and family care, by means of joint actions between employers and employees in labor market, besides the direction of state actions in order to fight off oppression factors in the domestic realm are important steps in this path, without which will not be possible to go further on the process of constructing gender equality. |

Mais il y a encore un chemin considérable à parcourir pour atteindre l'égalité de genre, car on s’est aperçu, au fil du temps, que l'inégalité est davantage le résultat de l'imposition de modèles de comportement differenciés pour les hommes et les femmes – les rôles dits de genre – au lieu des différences biologiques qui existent entre les sexes. Le rôle public joué par les femmes dans la sphère domestique privée les places dans une condition inferieure qui se propage à l'sphère publique non- domestique, de façon que la persistance des distorsions de genre puisse avertir de l'inefficacité du système juridique dans ce domaine. Si les pouvoir publics n’interviennent pas dans l’espace privé de l'individu, peu de progrès sera accompli dans la sphère publique non domestique, notamment dans le milieu social et dans le marché du travail. Cette pondération concerne la délimitation du contenu de la liberté et de la vie privée constitutionnellement prévues, ce qui vise à la protection des femmes. La fin des congés maternité et paternité, avec l'établissement du congé parental, la publicisation des tâches tâches ménagères et les soins de la famille, par des actions conjointes entre les employeurs et les employés sur le marché du travail, outre que le redressement des actions de l'Etat pour combattre les facteurs d'oppression dans la sphère domestique, tout cela comprend d’importantes étapes sur ce chemin, sans lesquelles nous ne pouvons pas avancer vers le processus d’édification de l'égalité de genre.Há mais de dois séculos, as mulheres lutam no mundo por igualdade, e faz cerca de trinta anos que as mulheres galgaram posição de igualdade formal na Constituição brasileira. Mas ainda há um longo caminho a ser seguido para a realização da igualdade de gênero, pois se percebeu, com o passar do tempo, que a desigualdade é muito mais fruto da imposição de padrões comportamentais diferenciados para homens e mulheres, denominados papéis de gênero, do que de diferenças biológicas existentes entre os sexos. O papel público desempenhado pelas mulheres no âmbito doméstico privado as coloca em situação de inferioridade, a qual se irradia para a esfera pública não-doméstica, de forma que a persistência das distorções de gênero pode ser sinal indicativo da ineficácia do sistema normativo nessa seara. Enquanto o Poder Público não adentrar na esfera privada do indivíduo, com vistas a corrigir as distorções de gênero no âmbito doméstico privado, pouco se avançará no âmbito público não-doméstico, especialmente no meio social e no mercado de trabalho. Essa ponderação perpassa pela delimitação do conteúdo da liberdade e da privacidade constitucionalmente previstas, quando voltadas à proteção das mulheres.
