Considering that Harry Potter has become an enormous and successful work, generating a great amount of fans of the author, as well as of the books, with a series of movies, games and other types of licensed products, it is expected that such series become the object of the most diverse types of study. Bearing this in mind, the current paper will take a unique approach to analyze this work as a whole. In the search for the likelihood of the work in the dichotomy between fiction and reality, the author used various systems in this endeavor, not being different in the creation of a magi-wizard legal system. Taking this into consideration, it is possible in the present work, through studies by authors such as Umberto Eco (1994), Rosemary Jackson (1981), Tzvetan Todorov (2010) and Farah Mendlestohn (2008) to search for these likelihood elements, which will be reaffirmed within the work in the separation, in this dissertation, in two thematic niches within the legal sphere, namely, the formation of the Magi-Witch Society taking into account the relationship of the elf-domestic with slavery and the judgments that occurred within the work. For that we will use within the legal doctrine Antonio Bento Betioli (2015) for an introduction to the study of law, Maria Helena Diniz (2015) and Joaquín Llambías (2009) to show relationship of society and people, Mirabete and Fabbrini (2015) and Michael Jefferson (2009) on the idea of penalization, and above all, the second, for elements of English law, and Valério de Oliveira Mazzuoli (2018) when dealing with International Law.
