THE URBAN DEVELOPMENT LEGAL FRAMEWORK AS A “NEW” LAW AND YOUR IMPORTANCE AS A SOCIAL TRANSFORMATION TOOL

Resumo: | Urban Law takes care of the built environment, which is one of the fundamental aspects for people's well-being, since much of what pleases or bothers people focuses on the built environment and the use we make of it. It was the Federal Constitution of 1988 that, finally, enshrined, in articles 182 and 183, principles of Urban Policy, related to the social function of the city and property, aiming to guarantee the well-being of its inhabitants. It is clear that Law 6.766/79 (Law of Land Parceling) established some social principles referring to its subdivision and dismemberment. But the specificity of the law has reduced its field of application. However, it was only in 2001 that Law n. 10.257/2001, better known as the City Statute, with the purpose, in addition to the regulation of articles 182 and 183 of the Federal Constitution, to establish the general guidelines of urban policy in the country. |

Foi a Constituição Federal de 1988 que, finalmente, consagrou, nos artigos 182 e 183, princípios de Política Urbana, atinentes à função social da cidade e da propriedade, visando garantir o bem estar de seus habitantes. É claro que a Lei 6.766/79 (Lei do Parcelamento do solo), deixou assentado alguns princípios de cunho social referentes ao seu parcelamento e ao desmembramento. Mas, a especificidade da lei reduziu seu campo de aplicação.
