Ações judiciais e direito à saúde: reflexão sobre a observância aos princípios do SUS

Resumo: The paper reflects upon the legal interpretations of the right to health and its consequences. In order to exemplify the complexity of the theme and its emotional appeal, it analyzes the Supreme Court's decision in a public litigation against the State of Alagoas demanding that medication be supplied. Different interpretations, by both judges and health professionals, of the notion of integral health care, one of the principles of Brazil's Health System, are examined. It is held that scarcity of resources must be taken into consideration when drawing up public policies that aim to allocate funding efficiently and in a manner that is compatible with the principals of the health system. Finally, the impact of judicial decisions concerning medication not offered by the system and the behavior of the Brazilian judiciary with this respect are discussed.

O artigo é uma reflexão sobre a interpretação do direito à saúde e suas conseqüências. Para exemplificar a complexidade do tema e o apelo emocional que suscita, parte-se da decisão de suspensão de tutela antecipada pelo Supremo Tribunal Federal, de uma ação interposta contra o Estado de Alagoas para o fornecimento de medicamentos. A noção de integralidade empregada no Sistema Único de Saúde é comparada àquela presente nos tribunais, manifestada por meio das suas decisões. Argumenta-se que a escassez de recursos requer a formulação de políticas para alocação compatível com os princípios de universalidade, integralidade, igualdade e eqüidade do sistema. Por fim, discute-se o impacto das ações judiciais de medicamentos não ofertados pelo sistema e o comportamento do judiciário brasileiro em relação a elas. Universidade de São Paulo.
