Resumo: | The aim of this article is explain the main ideas discussed at the Public Hearing n. 4, convened by the Minister Gilmar Mendes, dealing with subjects related to health. Intends to make a brief review of the Supreme Court jurisprudence after the public hearing in order to verify its influence on the decisions of the Ministers of the Supreme Court. It also a highlight the recent recommendation of the National Council of Justice to ensure greater efficiency in the settlement of litigation involving health care. In this paper, we examined the legalization of health, launched with the aim of contributing to the debate on the subject. With regard to judicial review, was analyzed, essentially, the recent decision by the plenary of the Supreme Court, which dismissed nine appeals by the Government against judicial decisions that led to the Unified Health System (SUS) to provide expensive drugs and treatments not offered by the system to patients of serious diseases which resorted to the courts. |

O artigo pretende expor as principais ideias discutidas na Audiência Pública n. 4, convocada pelo Ministro Gilmar Mendes para tratar de assuntos afetos à área de saúde. Busca, também, realizar uma breve análise da jurisprudência do Supremo Tribunal Federal posterior à realização da audiência pública, a fim de verificar sua influência nas decisões dos Ministros da Suprema Corte. É objeto de destaque, inclusive, a recente Recomendação do Conselho Nacional de Justiça no sentido de assegurar maior eficiência na solução das demandas judiciais envolvendo a assistência à saúde. Ainda, há, no trabalho, algumas impressões pessoais sobre a judicialização da saúde, lançadas com o propósito de contribuir no debate do tema. No tocante ao exame jurisprudencial, foi analisada, fundamentalmente, a recente decisão do plenário do STF, que indeferiu nove recursos interpostos pelo poder público contra decisões judiciais que determinaram ao Sistema Único de Saúde (SUS) o fornecimento de remédios de alto custo e tratamentos não oferecidos pelo sistema a pacientes de doenças graves que recorreram à Justiça.
