The goal of expanding the supply of childcare centers and the legalization of the right to education

Resumo: This article aims to evaluate the performance of Brazilian municipalities regarding the second part of Goal 1 of the Plano Nacional de Educação [National Education Plan] – to expand the supply of childcare centers so that, by the end of its term (2024), at least 50% of the children up to 3 years old are cared for – as well as to relate that performance with the phenomenon of judicialization of the right to early childhood education in the country. The research is socio-legal in nature and uses a qualitative methodology. The conclusion shows that the failure to meet Goal 1 in national terms reveals a persistent regional and socioeconomic inequality in the access to childcare centers. It also shows that judicialization contributes to accelerating the expansion of the supply which is heavily dependent on establishing partnerships with private institutions.

La investigación tiene carácter socio-jurídico y metodología cualitativa. Las conclusiones indican que el incumplimiento de la Meta 1 en términos nacionales revela una persistente desigualdad regional y socioeconómica en el acceso a guarderías, y la judicialización contribuye a acelerar una expansión de la oferta fuertemente dependiente del establecimiento de acuerdos con instituciones privadas.O artigo tem como objetivo avaliar o desempenho dos municípios brasileiros quanto à segunda parte da Meta 1 do Plano Nacional de Educação – ampliação da oferta de creches de modo a atender, até o final da vigência do plano (2024), no mínimo 50% das crianças de até 3 anos de idade –, bem como relacionar referido desempenho com o fenômeno da judicialização do direito à educação infantil no país. A pesquisa tem natureza sociojurídica e metodologia qualitativa.
