This monograph sought to learn about the principle of separation of powers and the theory of brakes and counterweights. The main objective of the work was to analyze the efficiency and importance of the separation of powers for Brazilian democracy, as well as evaluating the applicability of the brake and counterweight system in the current Brazilian political scenario. Furthermore, the aim of this research was to describe the historical evolution of the division of state powers, describe the concept of the system theory of checks and counterweights, analyze the constitutional principle of tripartition of powers and finally to check what limits of control the Union's powers exercise between them. To this end, the work used exploratory research, through documentary and bibliographic sources. The main conclusions were that the principle of separation of powers and the theory of brakes and counterweights remain valid and effective in Brazil, in the face of the crisis experienced in 2020. It is concluded that in order to ensure better efficiency of government acts, it is necessary to relax the constitutional principle of the separation of powers, so that each power can perform intense supervision and control over the other. However, the limits of constitutionally provided independence must be respected in order for harmony to occur in the country.
