Resumo: OBJECTIVE: To analyze the possibility of judicial recognition of the family parallel to marriage or to a stable union, based on doctrinal and jurisprudential understandings. METHOD: The nature of the research is qualitative, given the exploratory level, using the technical procedures of bibliographical and documentary research. RESULT: Although the doctrine and majority jurisprudence say that there is no possibility of judicial recognition of the family parallel to marriage or stable union, the number of jurists and judges who accept the parallel family as legitimate, begins to grow, deserving judicial recognition. CONCLUSION: On the basis of the results, I conclude that the right has to run to keep pace with changes in society, and can no longer turn a blind eye to reality, parallel families exist and must have their rights recognized, can not be left out of society.

MÉTODO: A natureza da pesquisa é qualitativa, deu-se em nível exploratório, utilizando-se os procedimentos técnicos de pesquisa bibliográfica e documental. RESULTADO: Embora a doutrina e a jurisprudência majoritária digam que não há possibilidade do reconhecimento judicial da família paralela ao casamento ou a união estável, começa a crescer o número de doutrinadores e de julgados que aceitam a família paralela como legitima, merecendo sim reconhecimento judicial.
