Resumo: OBJECTIVE: This monographic project aims to analyze the right of custody and visit concerning multi-parenting, based on doctrines and jurisprudence. METHOD: For this purpose, a qualitative approach was used, through which articles, doctrines and jurisprudence were analyzed. The procedure adopted for the collection of data was bibliographical and documental, making use of prepared materials on the subject and of jurisprudential decisions respectively. RESULTS: The family is the society basis and family Law has been adapting to changes in family structure, which, in turn, stem from the evolution and transformation of society. Coming from the Federal Constitution, other forms of family formation beyond the matrimonial one were admitted. In this context, multi-parenting, that is, the possibility of dual filiation, came to be accepted by doctrine and jurisprudence, although there are differences regarding the subject in terms of its recognition and its legal effects. CONCLUSION: In the absence of legislation to regulate custody and the right to visit in multiparenting, if the child has a record of double paternity, custody and visit rights must occur in a interspersed way between the two of them. Visit.OBJETIVO: O presente trabalho monográfico tem como objetivo analisar o direito de guarda e visita na multiparentalidade, com base em doutrinas e jurisprudência. MÉTODO: Para tanto, foi utilizada uma abordagem qualitativa, por meio da qual foram analisados artigos, doutrinas e jurisprudências. O procedimento adotado para a coleta de dados foi bibliográfico e documental, fazendo-se uso de materiais preparados sobre a temática e de decisões jurisprudenciais respectivamente. RESULTADOS: A família é a base da sociedade e o Direito de família vem se adequando às modificações da estrutura familiar, que, por sua vez, decorrem da evolução e das transformações da sociedade. A partir da Constituição Federal, passou-se a admitir outras formas de constituição de família além da família matrimonial. Nesse contexto, a multiparentalidade, ou seja, a possibilidade de dupla filiação, passou a ser aceita pela doutrina e pela jurisprudência, apesar de haver divergências quanto ao tema em relação ao seu reconhecimento e aos seus efeitos jurídicos. CONCLUSÃO: Na ausência de legislação para regular a guarda e o direito de visita na multiparentalidade, se a criança possui registro da dupla paternidade, a guarda e o direito de visita devem ocorrer de forma intercalada entre uns e outros.
