Resumo: This monographic work aims to analyze the possibility of the recovery of precarious possession based on the principle of the social function of possession. In order to achieve the main objective of scientific work, its structure is divided into five chapters. The first chapter deals with the introduction. The second chapter analyzes real law from a civil-constitutional perspective, focusing its study on property, from its origin, historical evolution, to its social function. In turn, the third chapter deals with the possession institute, notably its concept, its distinction between property and detention, its legal nature, its classification, its mode of loss, as well as its acquisition and, finally, its effects. The fourth chapter brings the doctrinal and jurisprudential construction on the topic under discussion. And the fifth and last chapter presents the final considerations of the research.

A fim de atingir o objetivo principal do trabalho científico, tem-se em sua estrutura uma divisão em cinco capítulos. O primeiro capítulo trata da introdução. O segundo capítulo analisa o direito real em uma perspectiva civil-constitucional, concentrando seu estudo na propriedade, desde a sua origem, evolução histórica, até sua função social. Por sua vez, o terceiro capítulo aborda o instituto da posse, notadamente, seu conceito, sua distinção entre propriedade e detenção, sua natureza jurídica, sua classificação, seu modo de perda, bem como de aquisição e, por fim, seus efeitos. O quarto capítulo traz a construção doutrinária e jurisprudencial sobre o tema em comento.
