The law has several ramifications that are necessary to meet man's desires. Promote the right to meet social demands, requires its due formalization. One of the functions of public administration is to regulate the conduct of public officials correcting offenders and immoral misconduct before the public administration. However, this "oversight" part of administrative disciplinary proceedings should be subject to the minimum constitutional principles, which are the wide defense and the contradictory. Using bibliographic research as a method, it was possible to analyze the validity of the disciplinary administrative process at the constitutional level, concluding that this tool, in addition to being necessary for the Public Administration, goes in line with the current constitutional precepts.
