Resumo: Demonstrate the analysis of a possible (un) constitutionality of disciplinary punishments against disciplinary transgressions applied with restriction of freedom in the disciplinary regulation of the military police of the State of Santa Catarina together with the application of Law 13,967 / 2019. The nature of the research is exploratory level, using a qualitative approach, using bibliographic and documentary data collection. In its result, it was seen that the punishments of disciplinary transgressions with restriction of freedom are not unconstitutional, but Law 13,967 / 2019 came to prohibit this, so the RDPMSC cannot apply this type of penalty for transgressions. In the end, it can be concluded that the punishments for disciplinary transgressions with restriction of freedom present in the RDPMSC are contrary to the amendment brought by Law 13,967 / 2019, going against a hierarchically more comprehensive law, therefore, they are illegal.

Quanto à natureza da pesquisa, o nível é exploratório, utilizandose de uma abordagem qualitativa, usando coleta de dados bibliográfica e documental. Constatou-se que, as punições das transgressões disciplinares com restrição de liberdade não são inconstitucionais, mas, a Lei 13.967/2019 passou a vedar isso, assim o RDPMSC não pode aplicar esse tipo de pena para as transgressões.
