Resumo: This monograph is prepared to analyze the family situation after the marriage dissolution as well as the coexistence of the grandparents with their grandchildren. For those concepts to be exposed, a bibliographic survey about the theme is necessary, which contributed to the development of this research. The structure of the monograph is divided into chapters, the first mentions: theme, delimitations, problems, objectives and justification. The second chapter will mention family law, stating that it is something that already comes from the Constitution, it also addresses family coexistence, which is a duty of the family, society and the State, assured to the child. The third chapter will discuss marital formation and separation. The fourth chapter mentions the custody of the minor children, the right of visits and the familiar coexistence. The fifth chapter deals with grandparents' right to visit grandchildren. It is emphasized with research, that it should be prioritized what is best for the minor children, in a process of separation many alternatives may be feasible.

Para que tais conceitos sejam expostos é necessário um levantamento bibliográfico acerca do tema, metodologia esta, que contribuiu para o desenvolvimento desta pesquisa. A estruturação da monografia se distribui em capítulos, o primeiro menciona: tema, delimitações, problemática, objetivos e justificativa. O segundo capítulo mencionará o direito de família, afirmando que é algo que já vem desde a Constituição, aborda também a convivência familiar, que é um dever da família, da sociedade e do Estado, assegurado à criança. O terceiro capítulo irá discorrer a respeito da dissolução da sociedade conjugal. O capítulo quarto menciona acerca dos direitos dos pais em relação aos filhos menores, a guarda dos filhos menores, o poder familiar e a perda dele. O quinto capítulo aborda o direito de visitas dos avós aos netos menores.
