Resumo: The present will address the possibilities of double vacation pay admitted in Brazilian labor law, respecting the wording instituted by the Labor Reform in 2nd paragraph of article 8 of the Consolidation of Labor Laws. This occurs, since in the Consolidation of Labor Laws only one possibility of remuneration in double is allowed and in the Precedents of the Superior Labor Court two other bend possibilities. It so happens that the 2nd paragraph of article 8 of the Consolidation of Labor Laws restricts the jurisprudential freedom so that it does not create or restrict rights, which may result in the inapplicability of the Precedents.
