Resumo: The present monographic work aims to analyze the institution of extrajudicial usucapião as a form of acquisition of real estate property and its regulation. To do so, it was necessary to study and approach the elements that make up the theme, discussing the concept, origin, classification, acquisition and effects of ownership, as well as the emergence, concept, characteristics, acquisition and social function of the property and by and the recognition and grounds for the acquisition of real estate through the extrajudicial route. For the accomplishment of the research was used scientific method of deductive approach. As for the level, it is classified as exploratory. Regarding the approach, in qualitative and technical data collection procedure is bibliographical and documentary. Following the necessary studies, it was verified that extrajudicial usucapião seeks the effectiveness of property consolidation for a reasonable time, less costly as well as extricate from the judicial processes that do not have a litigation. It was concluded that in order to consolidate ownership through the extrajudicial route, it is necessary to fulfill several requirements established by law as well as administrative requirements that may be required by the landowners.

Para tanto, fez-se necessário o estudo e abordagem dos elementos que compõem o tema, discorrendo sobre o conceito, origem, classificação, aquisição e efeitos da posse, bem como o surgimento, conceito, características, aquisição e função social da propriedade e, por fim, os requisitos, espécies da usucapião, a desjudicialização de processos no ordenamento jurídico brasileiro e o reconhecimento e fundamentos para a aquisição da propriedade imobiliária por meio da via extrajudicial. Para a realização da pesquisa foi utilizado o método científico de abordagem dedutivo. Quanto ao nível, classifica-se como exploratória. No que tange à abordagem, em qualitativa e quanto ao procedimento técnico de coleta de dados é bibliográfica e documental. Realizados os estudos necessários, verificou-se que a usucapião extrajudicial busca a efetividade da consolidação de propriedade por um tempo razoável, menos custoso, bem como desafogar do judiciário processos que não possuem um litígio.
