This research aims to identify the shape of the responsibility to protect from the optics of International Law. Therefore the historic construction of human rights was analyzed; it was described the concepts of sovereignty as well the evolution of those concepts over the years. It was presented a brief historic of the conflicts that happened during history; besides that it was approached the matter of humanitarian intervention and it was punctuated the legal possibility, its shapes and concept. Besides that, it was contextualized the Responsibility to Protect with the shapes of intervention and sovereignty one serving the divergence among these three concepts and it demonstrated the historic construction of the concept. Lastly it was analyzed the Responsibility of Protection and its relevance when applied with the Responsibility to Protect. Hence it was utilized the exploratory method regarding the object of the research, qualitative method regarding the problem approach and bibliographic and documental for data collecting. Thus the researchers concluded that the state has the responsibility to protect its citizens when it verifies that there is no violation of human rights and when the state isn’t capable to support this responsibility, the duty will fall over the the international society. Therefore, Responsibility to Protect proposes a redefinition of the state sovereignty to its citizens which the formal concept of sovereignty defined by the state control transforms into the state responsibility to protect its individual.
