The main goal of this study is to demonstrate the difficulty in determining the legal maternity of children born from surrogacy due to the lack of standardization for assisted reproduction methods in Brazil. For this, as for the level, this work adopted the exploratory method, as for the approach it was adopted the quantitative technique. At first moment, Bioethics and Biolaw were conceptualized, followed by a brief study about its basic principles. Then it was discussed about assisted reproduction techniques, followed by a brief explanation of infertility and sterility and the desire to be a mother, shortly thereafter it was discussed about maternity and filiation. At last, it ended with a brief review of previous medical resolutions, until the resolution number 2121/2015. Finally, it was approached about the possible mothers who were part of the surrogacy, with a shortly individual explanation of their functions in the aforementioned procedure. Next, the draft of proposed law number 7591/17 was analyzed briefly, then it was talked about the need of the standardization of the theme, the discussion continued about free family planning, ending with a quickly discussion about the determination of the maternity for the children who was born through surrogacy.
