Resumo: The present work seeks to analyze the possibility of continuity of the company in judicial recovery when the failure to comply with the recovery plan regarding the payment of labor claims. It addresses the institute for the judicial recovery of the entrepreneur and the companies and the protection given to the labor credits during the recovery process. In case of non-compliance with the judicial recovery plan, Law 11,101 / 05 requires the convolution of the judicial reorganization in bankruptcy. By means of the jurisprudential analysis, it is sought to verify the position of the courts regarding the possibility of the continuity of the company's activity when it occurs the non-fulfillment of the recovery plan regarding the payment of labor claims, in considering the principles of the company's social function and continuity of the company's activity against the protection given to labor claims in judicial reorganization. The methods used were bibliographic and documentary research. In the end, by analyzing the collated judgments, it can be concluded that if there is a non-compliance with the recovery plan in relation to labor claims, payments and deadlines and are respected, the protection of labor claims will generally prevail over detriment to the principles of continuity of the company and its social function and the recuperanda company will suffer the convolation of the recovery in bankruptcy.

Aborda o instituto da recuperação judicial do empresário e das sociedades empresárias e a proteção dada aos créditos trabalhistas durante o processo de recuperação. Em caso de descumprimento do plano de recuperação judicial, a Lei nº 11.101/05 impõe a convolação da recuperação judicial em falência. Por meio da análise jurisprudencial, busca-se verificar o posicionamento dos tribunais acerca da possibilidade da continuidade da atividade da empresa quando ocorre o descumprimento do plano de recuperação quanto ao pagamento dos créditos trabalhistas, em se sopesando os princípios da função social da empresa e da continuidade da atividade da empresa em contraponto com a proteção dada aos créditos trabalhistas na recuperação judicial. Os métodos utilizados foram a pesquisa bibliográfica e a documental.
