Análise do número de infrações de porte de drogas para o consumo pessoal na cidade de Tubarão - SC: comparativo entre e a revogada e a vigente Lei de Drogas

The present work has as general objective to analyze the effectiveness of Law of current drugs, without control of the number of infractions of possession of drugs for personal consumption, taking into account the increase, stability or decrease of occurrence rate. For this purpose was used hypothetical-deductive approach method, given a statistical observation and confrontation between a revoked and current Drug Law. Regarding the development of the work, it was adopted, in terms of volume, the study is descriptive. The research technique used in the bibliographical model, performed through doctrines and legislation, as well as documentary, elaborated through an analysis and analysis of the data provided by the 5th Battalion of the Military Police of the City of Tubarão – SC. As for the research method used in the quantitative scope, without any value judgment, where the fact of being updated and exclusive in the data obtained during the research is demonstrated. It was seen as a result of this research, based on the analysis of the records of occurrences of Tubarão's 5th BMP-SC from 2004 to 2016 on the crime of possession of drugs for personal consumption, in relation to the period of validity of Law n° (6.688/76) to the simple arithmetic average of 88 (eighty-eight) annual occurrences, on the other hand, in Law n° 11.343/06, the simple arithmetic mean of 211 (two hundred and eleven) annual occurrences was verified. According to the research, it was concluded that there was an increase of 139,77 % in the index of occurrences in comparative to the revoked and current Drug Law, so the current legislation is not effective in relation to the control of the number of infractions of the crime of postage in accordance with the repealed legislation, why, contrary to the concept of effectiveness in the control of criminal offenses, there was a greater incidence on the crime in question under Law n° 11.343/06.
