This paper consists in a exploratory case study, aiming to elucidate the main environmental risks present in the construction business through an analysis of appeals judged by the 12th region of the Regional Labor Court in 2018. In order to understand all the points used in the processes, it is discussed about the Regulatory Norms, laws, the Consolidation of Labor Laws and also about the civil construction in general, creating a theoretical reference to be used as a basis for the study. We sought to understand the main arguments used in the Expert reports to assess whether the activity was healthy or not, as well as understand the arguments of the judges to grant or reject the requests, seeking a greater understanding of the general operation of the case. Also listed are the main harmful agents found in the field of construction, as well as the tolerance limits (if any) and the degree of unhealthiness for each case. In the end, 11 cases were selected and an analysis was made highlighting the main reasons for the request, the number of cases accepted and the proportion in which the judges accepted the conclusion of the Expert report.
